THE CONTRACT BETWEEN US & YOU THE PURCHASER
When you place an order with us, you are making an offer to buy goods. We will send you an e-mail to confirm that we have received your order. Once we have checked the price and availability of the goods, we will e-mail you again to confirm that we accept your order, and that a contract has been made between us. We will not take payment from you until we have accepted your order. In the unlikely event that the goods are no longer available, or that we have made a pricing mistake, we will advise you of this. You will not receive an e-mail confirming acceptance of your order, and there will be no contract between us. If the goods you order are not available, we may supply you with substitute goods. If you decide not to accept the substitute goods, you will not have to pay to return them to us. All descriptions of the goods are given by the artist, and may not be accurate. Therefore any such description does not form part of this agreement. Your contract is with us, not the artist, and you may not communicate under any circumstances with our artists in regard to sales, commissions, refunds or returns
CONTRACTUAL LIMITATIONS
When goods are provided without a charge, they are not to be associated with any service for which a charge is made. There is, therefore, no obligation on us in respect of such goods.
YOUR INFORMATION
You must supply us with accurate and up to date information regarding your name and valid delivery/billing address, to enable us to deliver your goods. We will try to respond to any dissatisfaction you have, as long as you contact us within three months of your purchase
PRICE & PAYMENT
The full price of your order must be paid before we can despatch any part of it and the charges will be borne by us on any item or items totaling £50 or more. You will be responsible for any charges relating to a payment made in a currency other than pounds sterling. Any details we give regarding exchange rates are only approximate and may vary
HOW TO ORDER
Ordering from us couldn't be simpler. Select the print you would like to buy from the Galleries or Artists sections of the website. On the right-hand-side of the image you will see a grey box headed Options. Next to that a price is shown in bold type. This is the default price and refers to buying the print unmounted. If you prefer to purchase the print ready-mounted or fully framed please access the drop-down option via the small downward-pointing triangle. Once you have selected your preferred option and entered the quantity you would like to purchase, click once on the Add to Basket link. This will take you to the Shopping Cart page. This page will show the item/s you intend to purchase in visual form, the quantity of each selection and the price. If you would like to remove an item from the shopping cart click the Dustbin icon ajacent to the product and it will be removed from the cart. If you are satisfied with your intended purchas/es you can Proceed To Checkout by clicking the link provided. This will take you to the Address Details page which is a simple 5 step procedure from Checkout to Complete.Complete each step as directed through to final payment and completion.
DELIVERY
All print orders will be acted upon one day on from recieving them. We have a 30 day delivery schedule from receipt of your order through to despatch and final delivery. The carrier will deliver to the address given in your order. Someone must be there to accept the delivery. If we are unable to make delivery within 30 days of your order date, you will be notified by email to arrange another delivery date. The goods may be delivered in instalments if not all the goods are available at the same time. If the goods are lost or damaged in transit, please let us know promptly, so that we can make a claim against the carriers. We will offer you the choice of a replacement or a full refund. Our service includes free delivery on all orders of £50 or more.
CANCELLATION & RETURNS
You are buying goods by mail order, and you therefore may have a right of cancellation. If you do, the following terms apply; This cancellation policy does not affect your rights when we are at fault — for example, if goods are faulty or mis-described. This policy does not apply to the following service, which is exempt from the right to cancel: You may not cancel orders for specially and specifically commissioned art works. You can cancel your contract before delivery, and up to 7 working days after delivery. To do this, please e-mail us or write to us. We will refund your money, including the original postage charges, within 30 days. You do not have to give any reason for cancellation. However, a brief explanation will help us to improve the service we offer to customers in the future. Any correspondence about the return of goods will be between you and us. The artist must not be contacted directly for any reason. If you cancel, you must return the goods to us at your own expense. You are responsible for the risk of loss or damage when you return goods, so you should take out enough postal insurance to cover their value. If you fail to return the goods, we will collect them, and we will charge you the direct cost of collection. If you fail to take reasonable care of the goods before they are returned to us, and this results in damage or deterioration, we will charge you for the reduction in value.
DAMAGED GOODS
If there is a problem with the goods, please contact us to discuss the matter further. If the goods are found to be damaged within a month of delivery, you may reject them and a replacement will be provided. If a replacement is not available, you may claim a part or full refund.
DISCLAIMERS
We may make changes to our web site, the contents of the site, or the goods, at any time without prior notice. Content may include technical inaccuracies. We reserve the right to refuse any order for whatsoever reason.
No warranty is given as to:
The adequacy of the goods for your purpose.
The truth of any information on our website.
Any implied warranty or fitness of goods for a particular purpose.
Our liability in any claim against us is limited to the value of the goods purchased.
Property Rights & Consent
Title and ownership rights shall remain the sole property of Kallos Fine Art and its exhibiting artists.
You may not copy, reproduce, modify, or in any way exploit any of the content.
Content may be copied or downloaded only for your own personal use.
System Security
You agree that you will not violate any aspect of the installation’s security.
You will not modify, copy or damage any part of our web site or any software used on it.
Any such violation is unlawful, and may result in criminal prosecution.
Violation means accessing data without consent, or breaching security.
You may not attempt to interfere with service to any user.
You must not take any action to obtain goods that you are not entitled to.
Third Party Rights
Nothing in this agreement, or on our web site, shall confer on any third party any benefit under the provision of the Contracts (Rights of Third Parties) Act 1999.
Indemnity
You agree to indemnify us against any claim, including lawyers’ fees, made by a third party, arising in any way from your use of our web site, or any infringement by you, or by any other person using your computer, of any intellectual property or other right of any person.
Severability
If any of these terms is held by jurisdiction to be void, invalid or unenforceable, then it would be changed to the minimum extent necessary to bring it within the laws of that jurisdiction and will not affect any other of these terms.
Force Majeure
We will not be liable for a breach of our obligations arising from something beyond our reasonable control, for example, strikes of our employees, suppliers or carriers.
Dispute Resolutions
In the event of any dispute arising from these terms, or any contract between you and us, you will attempt to settle such dispute with us in a process of mediation, before commencing litigation.
Governing Law
This agreement shall be governed and construed in accordance with the law of England only.
CHANGES TO THESE TERMS
These terms were last changed on 14 June 2013 These terms apply to your order. We may change our terms and conditions at any time, so please do not assume that the same terms will apply to future orders.
